USHoldMail.com (“USHoldMail”), together with our affiliates and licensees, (collectively, "we," "us," or "our,") operate www.usholdmail.com (the "Site") whereby we offer certain services, including, but not limited to our Hold Mail service (our "Services"). Any use of this website is subject to the following Terms & Conditions (the "Terms"), which sets forth the terms and conditions that apply to your access and use of the Site and the terms and conditions under which we provide our Services. If you do not agree with the terms and conditions of this User Agreement, you may not access, visit and/or use the Service. The User Agreement may be modified from time to time, so check back often.

USHoldMail.com is operated by a private company which is not a government website, nor is it affiliated with, endorsed, or approved by the USPS or any government agency. USHoldMail.com offers a membership based service that specializes in providing assistance with scheduling and placing mail hold requests that the USPS cannot accommodate, while simultaneously offering customers ancillary benefits. All services include experienced and helpful support, available by phone and e-mail. The membership fee we charge is in exchange for the services and benefits we provide, not for the actual mail hold itself. The USPS service for holding mail can be filed for free online at usps.com or at a local post office if you prefer to file your own, although certain scheduling restrictions may apply.

We reserve the right to investigate any and all suspected violations of these Terms of Use and to take any and all necessary or appropriate actions to remedy such violations, as we may determine in our sole discretion.

For information about USHoldMail.com's data protection and privacy practices, please read USHoldMail.com's Privacy Policy, which is hereby incorporated by reference into this Agreement.

Services

USHoldMail.com's Services may include, but aren't limited to:

  • Filing an official USPS hold mail requests with the United States Postal Service on behalf of the User.
  • Transmitting opt-in or opt-out requests to third parties on behalf of Users indicating an interest to learn more about applicable services or products
  • Transmitting mailing suppression requests to third party data brokers and/or the Direct Marketing Association on behalf of the User and only as instructed by the User
  • Activation of an Account & Hold Mail Requests

    In order to use the services provided, users must create and activate a USHoldMail.com account. An account with USHoldMail.com lasts for 6 months or 1 year from the date of activation based on the service package you purchased.

    Once an account has been created, users must properly complete and submit the hold mail request consistent with the hold mail form requirements of the USPS. It is the customer’s responsibility to ensure that all information submitted is accurate, complete and consistent with the online hold mail form requirements of the USPS. USHoldMail.com will attempt to process a hold mail request using the exact information provided by the user. If a hold mail request is made to this service with incorrect, inconsistent or incomplete information, USHoldMail.com reserves the right to make necessary adjustments when reasonable, or to entirely refrain from completing the request. When applicable, we will make our best efforts reach out to the customer to rectify any uncompleted requests.

    Once the user has submitted the information through our system, USHoldMail.com will immediately attempt to complete their request. Once the hold mail request has been finalized and confirmed, any and all issues arising from the hold mail request are no longer the responsibility of USHoldMail.com.

    The mail hold will apply to all mail for the specified address. If you are looking to hold only a certain individual's mail at the provided address, we advise that you do not use this service.

    Mail holds are not available for PO boxes.

    Activation of a USHoldMail.com account does not guarantee nor does it confirm that a hold mail request has been successfully placed. A hold mail confirmation email from the USPS confirms that a hold has been confirmed with the USPS for the address provided. USHoldMail.com uses the email address provided by its customers to place mail holds with the USPS. This provides the customer with the correct information if changes are needed on their mail hold requests.

    A mail hold period is deemed to begin on the 'start date' with mail being returned, or ready for pickup, on the 'end date'. An extension to the end date of a mail hold is only obtainable if the request for the extension is made prior to the end date. Once the mail hold period has begun, no further extensions to the start date can or will be put into effect. Further, an edit request to adjust the accumulated mail collection option from “carrier” to “pickup,” or vice versa, must be made prior to the end date if the change is to have any effect.

    The USPS mail hold period can last for up to thirty days. Customers who have requested multiple consecutive mail holds in an effort to extend the thirty day limit are cautioned that accumulated mail from the initial request will not continue to be held by virtue of a second consecutive hold mail request. While USHoldMail.com offers the option of making multiple mail hold requests at once, the responsibility to attend to the accumulated mail stays with the customer at the end of every mail hold period.

    If there is already an active mail hold on your address that was not placed by USHoldMail.com, we do not have access to cancel that request and are not able to put on a new mail hold until that active hold is either cancelled, or we have reached the end of the hold dates. It is the responsibility of the customer to ensure that any active hold mail requests are cancelled or to provide us with the end dates of the existing hold, so that we may process the new hold request through USHoldMail.com. If we cannot schedule a hold mail request because there is an existing active hold, and we have not received the details of the existing hold, USHoldMail.com will not be held responsible in any way for not scheduling such a hold mail request.

    USHoldMail.com is only a service provider. We do not hold any physical items for customers. We only assist in putting mail services on hold. As such, we are not responsible for any non-delivery of items after the mail hold period has ended. If your mail hold period, as so requested, has ended and regular delivery has not restarted, we are in no way answerable or accountable for this unrelated occurrence and will not make any further inquiry or take any further action on the matter. If you cannot locate or have not received your accumulated mail at the conclusion of the mail hold period, or if regular delivery has not recommenced, please contact your local post office.

    Cancellation of an Account

    To cancel an account, users should reference the Contact US page to find the best way to contact us and inform of us of a cancelation request. Please refer to the Refunds section for further details on our refund policy. Once an account with USHoldMail.com has been cancelled, we are not required to provide any further service or take any further action on your behalf. This includes cancelling any mail hold requests that may have been processed while the account was open.

    To cancel an account, users should reference the Contact US page to find the best way to contact us and inform of us of a cancelation request. Please refer to the Refunds section for further details on our refund policy. Once an account with USHoldMail.com has been cancelled, we are not required to provide any further service or take any further action on your behalf. This includes cancelling any mail hold requests that may have been processed while the account was open.

    Customers requesting a cancellation of a hold mail request without requesting refund are deemed to be requesting a cancellation of a mail hold request only, and not a cancellation of their account with USHoldMail.com.

    USHoldMail.com will make commercially reasonable efforts to implement our Services by contacting various third parties as requested by our Users, but we don't guarantee successful notification and we aren't responsible for the actions or omissions of the third parties we contact on behalf of Users.

    USHoldMail.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. As set forth in detail below, you agree that USHoldMail.com shall not be liable to you or to any third party for any modification, suspension, failure or discontinuance of the Services.

    USER AUTHORIZATION

    By accessing the Website and using the Services in any way, you are agreeing to comply with and be bound by the conditions of these Terms. In addition, when using the Website and its Services, you agree to abide by any applicable posted guidelines for all USHoldMail.com Services, which may change from time to time, and to comply with all applicable laws and regulations. Should you object to any of the terms or conditions of these Terms, any guidelines, or any subsequent modifications thereto or become dissatisfied with USHoldMail.com in any way, you should immediately discontinue use of the Website. These Terms will remain in full force and effect as long as you are a user of the Website and in the event of termination of any membership, service or feature, you will still be bound by your obligations under these Terms, including any indemnifications, warranties and limitations of liability.

    You agree that by using this service you are at least 18 years of age and you are legally able to enter into a contract. You also represent that you have the capacity to be bound by it or, if you're acting on behalf of a person or entity, that you have the authority to bind such person or entity to it. If you do not agree to these terms, do not use this website. It is your responsibility to periodically review these Terms. Nevertheless, USHoldMail.com reserves the right, at any time, to change the Terms by publishing notice of such changes on the Website. Any use of the Services by you after USHoldMail.com's publication of any such changes shall constitute your acceptance of these Terms, as modified.

    You agree that USHoldMail is permitted to access and use any information you provided to us for any reason relating to the Service that we deem appropriate.

    You understand and agree that we may review and delete any content that you provide, including messages, identifiers, company names or profiles that in our sole judgment violates this Agreement, or that may be offensive, illegal, inaccurate or that may violate the rights of others.

    By using USHoldMail.com's Services, you authorize USHoldMail.com to act as your authorized agent. For USPS hold mail requests, you must be acting on your own behalf or you must be the person, executor, guardian, authorized officer, or agent of the person for whom mail would be redelivered under this order. You certify that you understand that submitting false or inaccurate information on this form is subject to punishment by fine or imprisonment or both under Sections 2, 1001, 1702 and 1708 of Title 18, United States Code.

    For "do-not-mail" notifications, you must be the named recipient of the mailing(s) for which you're asking to be unsubscribed or, if such mailing(s) are addressed to "current resident", you must be the current resident at such address. If you're acting on behalf of someone else, you must have the express authorization from the named recipient of the mailings.

    For marketing list and other opt-out requests, you must be the person for whom the opt-out request is made and you must reside at the postal address for which suppression or opt-out is requested. If you're acting on behalf of someone else, you must have the person’s express authorization.

    You may terminate this Agreement and your account with USHoldMail.com at any time and for any reason by notifying us. We may terminate this Agreement with you, terminate your account, and elect not to implement our Services for you at any time and for any reason, effective upon sending notice to you at the email address you provided for your account.

    You agree and understand that you're responsible for maintaining the confidentiality of your account access information. If you become aware of any unauthorized use of your account information, you must notify us immediately.

    You're only entitled to access the Site and use the Services for lawful purposes. You shall provide true, accurate, current and complete information, and you shall not misrepresent your information or use or input on the Site any other person’s information without their express consent. Any fraudulent activity will be reported to federal authorities for prosecution.

    PRICING & REFUNDS

    Prices posted on the Website represent the fees which are payable to USHoldMail.com for your use of the Services.

    Your submission of any payment information (including, but not limited to credit card information) constitutes your authorization for USHoldMail.com to charge your card for the services ordered. You agree to abide by the terms of your card issuer's agreement.

    All Hold Mail Services are subject to a 100% satisfaction guarantee. USHoldMail.com will refund anyone requesting an account cancellation within 30 days of initial payment if you're not satisfied with your membership and the Services rendered. Refunds can often take three to ten business days from the date the refund was processed to appear on your credit statement.

    This site and all information or Services provided through this site, are provided “as is” and “as available,” without warranty or conditions of any kind, and we cannot guarantee and do not promise any specific results from use of this site. USHoldMail.com strives to keep its forms and documents accurate, current and up-to-date. However, we cannot guarantee that all of the government forms or information on the Website are correct, complete or up to date. USHoldMail.com makes no representations, warranties or guarantees, express or implied, regarding the accuracy, reliability, safety or completeness of the content on the site or of the services. Further, no representations or warranties, express or implied, are given regarding the legal or other consequences resulting from your use of the Services. As such, this Website is not intended to create any attorney-client relationship, and by using this Website no attorney-client relationship will be created with USHoldMail.com. Instead, you are representing yourself in any legal matter you undertake through the Website's Services.     By using USHoldMail.com and accepting these Terms, you hereby waive and agree to release and hold harmless USHoldMail, our subsidiaries, affiliates, licensors, licensees, service providers, content providers, employees, officers, directors, or agents during or as a result of investigations with respect to the use of the Website and from any and all actions taken as a result of such investigations by us, our subsidiaries, affiliates, licensors, service providers, content providers, employees, officers, directors, agents or by any law enforcement authorities.

    We will not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including loss of revenue or income, pain and suffering, emotional distress, or similar damages, even if we have been advised of the possibility of such damages. In no event will the collective liability of us and our subsidiaries, affiliates, licensors, service providers, content providers, employers, officers, directors, and agents to any person or party (regardless of the form of the action, whether in contract, tort, or otherwise) exceed the amount that you have actually paid to USHoldMail.com for the applicable contents or services out of which liability arose.

    DISPUTES

    If there is any claim, controversy or dispute at law or equity about this Agreement, the Site and/or the Services, you agree that you and we'll resolve any claim in accordance with this paragraph. This Agreement will be governed in all respects by the laws of the state of New York, without regard to its conflicts of law principles. With respect to any disputes or claims, you acknowledge and understand that exclusive jurisdiction over any cause of action arising out of this Agreement or the Services shall be in the state or federal courts located in or near New York City, NY. You agree to submit to the jurisdiction of such courts and you hereby waive all defenses of lack of personal jurisdiction.

    INDEMNITY

    You agree to indemnify, defend and hold us, our subsidiaries, affiliates, and licensors and their respective, directors, members, officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of this Site, Content or Materials in violation of this Agreement and/or arising from a breach of this Agreement and/or any dispute you may have with another user on the Site and/or any breach of your representations and warranties set forth above.     SEVERABILITY

    Any provision of this Agreement which is invalid, illegal, or unenforceable in any jurisdiction shall, as to that jurisdiction, be ineffective to the extent of such invalidity, illegality, or unenforceability, without affecting in any way the remaining provisions hereof in such jurisdiction or rendering that or any other provision of this Agreement invalid, illegal, or unenforceable in any other jurisdiction.

    AMENDMENTS

    USholdmail.com may without advance notice amend these Terms from time to time, and will do so by posting the new Terms on the Website in place of the old. It's your responsibility to check this Agreement periodically for changes and the most current version of the Terms of Use will supersede all previous versions. Each and every such amendment shall be become effective immediately upon posting to the Site and your continued usage of the Site will mean you accept those changes, including for all pre-existing accounts.
